7. Sizing and Fit

Where you require assistance, you may contact us before placing your order. Any sizing assistance we provide is based on the measurements and information supplied by you and cannot guarantee a particular subjective fit.

An incorrect size selected by the customer is not a manufacturing defect. Eligible standard-sized garments may nevertheless be considered for exchange or store credit under our Exchange, Store Credit & Statutory Returns Policy.

8. Made-to-Order Production

Many Rive & Rituel garments are made individually following purchase rather than being drawn from mass-produced stock.

Where a product is described as made-to-order, production will begin after your order has been accepted and payment has been authorised.

Estimated production periods are approximate and may vary according to:

  • Order volume
  • Fabric or trim availability
  • The complexity of the garment
  • Atelier capacity
  • Bespoke or custom requirements
  • Quality-control requirements
  • Events beyond our reasonable control

Production estimates are separate from carrier delivery estimates.

We will endeavour to notify you where we become aware of a material production delay. A delay does not automatically entitle either party to cancel where performance remains possible, except where cancellation or another remedy is required by applicable law.

9. Bespoke, Personalised and Made-to-Measure Products

Some products or services may allow customers to request bespoke sizing, personalised details, alterations, monogramming, custom colours or other non-standard specifications.

You are responsible for ensuring that all measurements, spelling, colours, instructions and personalisation details supplied to us are complete and accurate.

We may contact you to clarify a request before production begins. Production may be delayed until the required information is received.

Once bespoke or personalised production has begun, the order cannot ordinarily be changed or cancelled.

Made-to-measure, personalised or clearly customised products cannot ordinarily be returned, exchanged or credited merely because the customer has changed their mind or supplied incorrect information.

This restriction does not apply where:

  • The product is faulty
  • The product has not been made according to the confirmed specification
  • The wrong product has been supplied
  • Applicable law requires another remedy

10. Placing an Order

Products displayed on the website constitute an invitation for customers to submit an order. They do not constitute a binding offer by Rive & Rituel to supply every product shown.

When you place an order, you are making an offer to purchase the selected products subject to these Terms.

Where we cancel an order after payment has been collected but before goods have been supplied, the amount paid for the cancelled portion will be returned to the original payment method unless another arrangement is agreed or legally required.

We are not obliged to accept an order merely because payment has been temporarily authorised.

18. Store Credit

Approved store credit may be added to the customer account associated with the original order email address or issued through another identifiable credit method.

Unless otherwise stated or required by law, store credit:

  • May be used only for purchases made directly through Rive & Rituel
  • Cannot be redeemed for cash
  • Cannot be transferred or resold
  • Cannot be applied retrospectively
  • Cannot be used to purchase further credit or gift cards
  • Is subject to the currency and redemption conditions stated when issued

Store credit issued as a voluntary alternative to an exchange or change-of-mind return does not create a right to a cash refund.

This does not affect any statutory right to receive money through the original payment method where such a right applies.

19. Gift Cards

Gift cards, where available, are subject to any additional conditions displayed when purchased or issued.

Unless applicable law requires otherwise:

  • Gift cards cannot be exchanged for cash
  • Gift cards cannot be replaced if transferred to or used by an unauthorised person
  • Customers are responsible for keeping gift-card details secure
  • Gift cards cannot be used to purchase another gift card
  • Promotional gift cards may have separate validity conditions
  • Gift-card purchases may be excluded from promotional discounts

Nothing in this section overrides mandatory laws governing gift-card validity, expiry or redemption.

20. Promotions and Discount Codes

We may withdraw or correct a promotion where it contains an obvious error, has been used fraudulently or is being circulated contrary to its stated conditions.

We will not remove a valid promotion from an order already accepted unless the promotion was obtained or used unlawfully or fraudulently.

21. Order Changes

You should contact us immediately if you need to change:

We will try to accommodate reasonable changes where production has not begun.

Once production, personalisation, alteration or fulfilment has commenced, changes may no longer be possible.

A requested change is not confirmed until we have accepted it in writing. Additional charges may apply where the requested replacement or alteration has a higher value or requires additional work.

22. Order Cancellation

Requests to cancel an order should be submitted as soon as possible.

Standard products may be cancelled before acceptance or production begins, subject to applicable law.

Once a made-to-order, personalised, bespoke or made-to-measure product has entered production, voluntary cancellation may no longer be possible.

Where a statutory cancellation right applies, it will be honoured according to the applicable law and our Exchange, Store Credit & Statutory Returns Policy.

Nothing in these Terms removes cancellation rights that cannot lawfully be excluded.

23. Production, Dispatch and Delivery Estimates

Production and delivery dates are estimates unless we have expressly agreed in writing that a date is guaranteed.

Delivery times shown on the website ordinarily begin after production is complete and the parcel has been accepted by the carrier.

A tracking number or dispatch confirmation does not guarantee a particular delivery date.

Delivery may be affected by:

  • Customs processing
  • Carrier delays
  • Severe weather
  • Strikes or transport disruption
  • Public holidays
  • Incorrect address details
  • Missed delivery attempts
  • Remote-area services
  • Import inspections
  • Events outside our reasonable control

Where a delay becomes material, we will provide the assistance or remedy required by the applicable contract and consumer law.

24. Delivery Addresses

You are responsible for providing a complete and accurate delivery address.

We are not responsible for delays or additional charges caused by incorrect or incomplete information supplied by the customer, except to the extent that we contributed to the error.

Once an order has entered fulfilment or been dispatched, an address change may not be possible.

Where a parcel is returned because of an incorrect address, refusal, non-collection or repeated failed delivery, the customer may be responsible for reasonable reshipping or return costs, unless the delivery failure was caused by us or the carrier.

25. Delivery to Safe Places, Reception Areas and Collection Points

Where you instruct or authorise the carrier to leave a parcel:

  • In a safe place
  • With a neighbour
  • At reception or concierge
  • In a parcel locker
  • At a collection point
  • At another nominated location

Delivery to that nominated location may be treated as completed where permitted by applicable law.

You are responsible for ensuring that the nominated place is secure and suitable.

This does not limit our responsibility where a parcel was not delivered in accordance with the agreed instructions or where applicable law places the delivery risk on us until physical receipt.

26. Customs and Import Requirements

International orders may be inspected by customs authorities.

You are responsible for ensuring that the products may lawfully be imported into the destination country.

We may provide commercial invoices, origin information or other reasonable documentation, but we cannot control:

  • Customs-processing times
  • Import decisions
  • Local tax assessments
  • Carrier brokerage fees
  • Customs inspections
  • Restrictions imposed by the destination country

Where a parcel is refused, abandoned or returned because import charges were not paid, reasonable return, customs and reshipping costs may be deducted from any amount otherwise due, where permitted by law.

27. Risk and Ownership

Ownership of a product passes to you once we have received payment in full and the product has been delivered, unless applicable law provides otherwise.

Risk of accidental loss or damage passes in accordance with the law applicable to the order.

For consumer deliveries, nothing in these Terms transfers risk earlier than is permitted by mandatory consumer law.

28. Exchanges, Store Credit and Statutory Returns

Our voluntary exchange and store-credit service is governed by our Exchange, Store Credit & Statutory Returns Policy, which forms part of these Terms.

Unless another period is required by applicable law, a request under our voluntary exchange service must be submitted within five calendar days of delivery.

Eligible garments must satisfy all applicable return conditions, including requirements concerning:

  • Hygiene protection
  • Original tags
  • Wear and washing
  • Marks and odours
  • Packaging
  • Return authorisation
  • Proof of purchase
  • Inspection and approval

Submitting an exchange request does not guarantee acceptance.

No wording in these Terms or our exchange policy limits a remedy that must be provided for faulty, damaged, incorrectly supplied or materially misdescribed goods.

29. Faulty, Damaged or Incorrect Products

You should inspect your order promptly after delivery.

If a product appears to be faulty, damaged in transit or different from what was ordered, please contact us as soon as reasonably possible and provide:

  • Your order number
  • A description of the issue
  • Clear photographs
  • Packaging photographs where transit damage is suspected
  • Any other information reasonably required to assess the matter

You must not continue using, wash, alter or attempt to repair the product where doing so may worsen the issue or prevent proper assessment.

Following assessment, we will provide the remedy agreed with you or required by applicable law. Depending on the circumstances, this may include repair, replacement, exchange, price reduction, store credit or refund.

  • Improper storage
  • Alteration or repair by another person
  • Misuse, accident or ordinary wear and tear

This section does not apply where the underlying damage was caused by a manufacturing defect or where liability cannot lawfully be excluded.

31. Third-Party Retailers

These Terms apply only to purchases made directly through Rive & Rituel.

Products purchased through Zalando, Wolf & Badger, another authorised retailer, marketplace or stockist are subject to the contract and policies of the retailer that processed the payment.

Requests relating to shipping, cancellation, returns, refunds or exchanges for such purchases must ordinarily be directed to that retailer.

Rive & Rituel cannot directly refund a payment collected by another retailer.

This does not prevent you from contacting us about product-care questions or a suspected manufacturing issue.

32. Website Content

The content available through the website is provided for general product, brand and shopping information.

While we take reasonable care over the website, we do not promise that every item of content will always be:

  • Continuously available
  • Free from typographical errors

We are responsible for losses that are a reasonably foreseeable consequence of our breach of contract or failure to exercise legally required care.

For consumer orders, we are not responsible for losses that are purely commercial or connected with a trade, resale, profession or business activity where the products were purchased principally for personal use.

43. Events Beyond Our Reasonable Control

We are not responsible for a delay or failure caused by an event outside our reasonable control, provided that we take reasonable steps to reduce its effects.

Such events may include:

  • Severe weather or natural disasters
  • Fire, flood or epidemic
  • War, civil disorder or terrorism
  • Government restrictions or sanctions
  • Customs disruption

  • Cyberattacks despite reasonable protective measures
  • Closure or interruption affecting our atelier or suppliers

Our obligations will be suspended for the period reasonably affected by the event.

Where performance becomes impossible or the delay becomes substantial, either party may have the right to cancel the affected part of the order in accordance with applicable law. Any money due following cancellation will be handled in accordance with those legal requirements.

44. Business and Commercial Purchases

Where you purchase products wholly or mainly for commercial purposes, resale, professional styling, events, hospitality, editorial production or another business activity, additional or separate commercial terms may apply.

To the maximum extent permitted by law, Rive & Rituel will not be liable to a business customer for:

  • Loss of profit
  • Loss of revenue
  • Loss of business opportunity
  • Loss of anticipated savings
  • Loss of goodwill
  • Indirect or consequential commercial loss

Any agreed liability cap applying to a business transaction will be stated in the relevant wholesale, commercial or bespoke agreement.

This section does not apply to ordinary consumer purchases.

45. Responsibility for Your Breach

You are responsible for reasonably foreseeable loss caused by your unlawful use of the website, fraud or material breach of these Terms.

You will not be required to indemnify us for losses caused by our own negligence, breach, unlawful conduct or matters for which liability cannot legally be transferred.

Any claim under this section must be reasonable, evidenced and permitted by applicable law.

However, where you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you and cannot lawfully be excluded by agreement.

Nothing in these Terms prevents a consumer from bringing a claim before a court that has mandatory jurisdiction under applicable consumer law.

48. Severability
